Terms of Service

1. Acceptance of Terms

By accessing or using the Casa-Clery booking website (the "Site") you ("Guest," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site.

2. Definitions

• "Owner" / "we" / "us" – the legal entity that owns and operates Casa-Clery and this Site.
• "Property" – the villa known as Casa-Clery, including its grounds, fixtures, and furnishings.
• "Booking" – a reservation confirmed by us in writing and secured by payment.

3. Eligibility

You must be at least 18 years old and able to enter a binding contract. You represent that all information you supply is true and that you have authority to act for everyone included in the Booking.

4. Booking Process

1. Check availability and nightly rates on the Site.
2. Submit a booking request with accurate guest details.
3. Pay the Booking Deposit (30% of the total stay, unless otherwise stated).
4. Receive a written Booking Confirmation. Only then is your stay guaranteed.

5. Rates, Fees, and Payment

• Prices are quoted in EUR and include local taxes unless specified.
• The Balance and any Security Deposit are due 30 days before arrival.
• Accepted payment methods: major credit cards and bank transfer.
• Failure to pay on time may result in cancellation under §6.

6. Cancellation & Refunds

*Processing fees and third-party charges are non-refundable. We recommend travel insurance.

7. Check-In / Check-Out

• Check-in: from 16:00 local time on arrival day.
• Check-out: by 10:00 local time on departure day.

Early/late times may be arranged in writing and may incur a fee.

8. Occupancy & House Rules

• Maximum overnight guests: 8.
• No smoking inside the Property.
• No pets unless agreed in writing.
• No parties or events without prior consent.

Breach may result in immediate eviction and forfeiture of payments.

9. Guest Responsibilities

You agree to:

1. Maintain the Property in good condition and leave it tidy.
2. Report any damage or maintenance issues immediately.
3. Comply with local laws and quiet-hours ordinances.
4. Ensure minors are supervised at all times, especially near the pool.

10. Owner's Liability

We strive to ensure the Property is as described, clean, and safe. However, to the maximum extent permitted by law, we shall not be liable for:

• Injury, illness, or loss suffered by any Guest or visitor.
• Theft, acts of nature, utility outages, or events beyond our control.

Total liability is limited to the amount you paid for the Booking.

11. Force Majeure

We may cancel or modify a Booking without liability if events beyond our reasonable control (e.g., natural disasters, government restrictions) render the stay impossible or unsafe. Where feasible, a credit or refund will be offered.

12. Privacy

Personal data is processed in accordance with our Privacy Policy. We never sell guest data and use industry-standard security measures.

13. Intellectual Property

All Site content, trademarks, and images remain our property. You gain no rights except a limited license to access the Site for personal, non-commercial use.

14. Changes to the Terms

We may revise these Terms from time to time. The newest version supersedes prior versions and is effective upon posting to the Site. Continuing to use the Site after changes are posted constitutes acceptance.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of Belgium. Any dispute shall be submitted to the exclusive jurisdiction of the courts located in Belgium, unless mandatory consumer-protection rules provide otherwise.
